1. Who we are and what this covers

Kommunity ("Kommunity", "we", "us") is a software service operated from Switzerland. It turns a contract address posted in a Telegram or Discord group into a trade card, lets you execute the swap from your own wallet, records who called what, and pays a share of the platform fee to the group's treasury and back to you.

These terms are the agreement between you and Kommunity. They apply to kommunity.fun, to the Kommunity mobile applications, to the Kommunity bots in chat groups, and to every API those surfaces call. By creating an account, by accepting the terms during onboarding, or by executing a trade through Kommunity, you accept them.

We publish a version identifier on every one of these documents. When we change anything that affects your rights or obligations we raise that version, and Kommunity asks you to read and accept the new text before you can trade again. What changed is listed on this page under "What changed".

2. Eligibility

You may use Kommunity only if all of the following are true.

  • You are at least 18 years old and have the legal capacity to enter this agreement.
  • You are not a United States person, you are not located in the United States, and you are not acting for the benefit of a United States person. "United States person" has the meaning given by Regulation S under the U.S. Securities Act of 1933.
  • You are not located in, ordinarily resident in, or acting on behalf of anyone in a country or territory subject to comprehensive sanctions administered by Switzerland, the European Union, the United Kingdom or the United Nations.
  • You are not listed on, and are not owned or controlled by anyone listed on, any sanctions list administered by those authorities.
  • Using Kommunity does not breach any law that applies to you.

You confirm these statements when you complete onboarding, and you confirm them again every time you trade. Kommunity blocks traffic from countries on its geographic block list and may block further countries at any time without notice. Attempting to defeat that block — with a VPN, a proxy, a false attestation, or any other means — is a breach of these terms and ends your right to use the service.

3. Kommunity is not a custodian and not a broker

We never hold your assets and we never hold your keys. This is the central fact about how Kommunity works, and everything else in these terms follows from it.

  • Your funds stay in a wallet you control. That is either an embedded wallet provided by our wallet partner, whose keys are held under your control and are exportable by you at any time, or an external wallet you connect.
  • Kommunity's servers compose an unsigned transaction. You sign it, in your wallet. Our server then verifies that the bytes you signed are exactly the bytes it composed, and only then forwards the transaction to the Solana network.
  • Kommunity has no ability to move your tokens, to freeze them, to reverse a transaction, or to recover them. Nobody at Kommunity can do those things, for anyone, ever.
  • Kommunity does not take custody of client assets, does not accept deposits, does not operate an order book, does not match orders, does not quote prices as a principal, and does not hold or transmit fiat currency.

Kommunity is a software interface to public infrastructure — the Solana blockchain, a third-party routing aggregator, and public token data providers. It is not a bank, not a payment institution, not a securities dealer, not an investment adviser and not a portfolio manager. We do not give personalised advice of any kind, and nothing shown by Kommunity is a recommendation to acquire or dispose of anything.

4. Your account

You need an account to trade. You create one by authenticating through our identity partner with Telegram, a passkey or an email address, then choosing a handle and accepting these terms.

You are responsible for keeping access to your account and your wallet. Anyone who controls your authentication factors controls your account, and anyone who controls your wallet keys controls your funds. Kommunity cannot restore either. If you export your wallet key, you become solely responsible for its safekeeping.

Your handle is public. It appears on receipts, on group pages, on token pages and on leaderboards unless you turn that off in your settings. Do not choose a handle that impersonates someone, that infringes a trademark, or that would be unlawful.

One person, one account. Creating multiple accounts to manipulate a leaderboard, a referral reward, a cashback total or a competition is a breach of these terms.

5. Trading, fees and payouts

Every swap executed through Kommunity pays a platform fee of 1% of the input amount. Out of the fee, our routing partner retains a share off the top, and the remainder is split as follows:

  • 45 basis points to the treasury wallet of the group whose call you traded, or, where no group is involved and you arrived through someone's referral link, to that referrer;
  • 10 basis points back to you as cashback;
  • the remainder to Kommunity.

Fees are collected on chain by the routing partner, swept by Kommunity once a day, and paid out once a day. Amounts below a documented minimum accrue and are paid when they cross it. A group's treasury wallet is provided by that group's administrator and is never controlled by Kommunity: we send to the address the administrator set, and we cannot recover a payment sent to an address the administrator got wrong.

Cashback and treasury shares are calculated in SOL from fees that have actually been realised on chain. A fee collected in a token that cannot be sold is held, retried, and after thirty days written off with a note in the ledger; groups are paid on realised SOL only.

Network fees, priority fees, slippage, price impact and any transfer fee charged by a token itself are yours. They are not part of the platform fee and Kommunity does not receive them.

We may change the fee split for future trades. A change is announced before it takes effect and never applies retroactively.

6. What you must not do

You must not:

  • use Kommunity to launder money, to finance terrorism, to evade sanctions or to break any law;
  • post, call or promote a token you know to be a fraud, or in which you hold an undisclosed position you are about to dispose of into the audience you created;
  • manipulate a market, wash trade, or use several accounts or wallets to inflate a volume figure, a score, a leaderboard position or a reward;
  • impersonate another person, another group or Kommunity itself;
  • attempt to access accounts, data or systems that are not yours, probe our infrastructure for vulnerabilities without a written invitation, or interfere with the service's availability;
  • scrape, resell, or build a competing service out of data taken from Kommunity in breach of these terms;
  • circumvent a geographic block, a suspension, a rate limit or a kill switch.

We may suspend or terminate access, blacklist a token, or suspend a group at any time when we reasonably believe one of these rules has been broken, when we are required to by law, or when we must protect users. Where a suspension was automatic, the affected group's administrator can appeal it and a human reviews the appeal.

7. Groups, callers and the treasury

A group is a Telegram or Discord chat whose administrator installed the Kommunity bot and set a treasury wallet. The relationship between Kommunity and a group is governed by the Affiliate terms.

Kommunity does not moderate the content of a group, does not verify the claims a caller makes, and does not endorse any call. Scores, hit rates and leaderboards are computed mechanically from on-chain outcomes; they describe what happened and they predict nothing.

8. Availability and the kill switch

Kommunity is provided as is. We do not promise that it will be available, that a quote will be obtainable, that a transaction will land, or that the numbers shown by third-party data providers are accurate or current.

Kommunity operates a kill switch. When our monitoring detects that a dependency is failing — the network, the routing partner, a price source — or when we otherwise judge that continuing would harm users, we pause trading globally or for one group. While trading is paused, quotes and transaction building are refused. Existing positions are unaffected: they live in your wallet, and you can always trade them elsewhere.

9. Intellectual property

Kommunity owns the service, its software, its brand and its design. You get a personal, non-exclusive, non-transferable, revocable licence to use them for their intended purpose.

You keep the rights to what you post. By posting content that Kommunity displays — a handle, a group name, a group logo, a call, a receipt you share — you grant us a worldwide, royalty-free licence to host, reproduce and display it as far as is necessary to operate and promote the service.

10. Disclaimer and liability

Not investment advice. Tokens can go to zero.

Trading tokens on a public blockchain carries a serious risk of total loss. Read the Risk disclosure; it is part of these terms. Kommunity makes no promise about returns of any kind, and nobody at Kommunity is permitted to make one on our behalf.

To the fullest extent permitted by law, Kommunity is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost opportunity, lost tokens, or loss caused by the failure, fraud or insolvency of a third party — including a token issuer, a group, a caller, a wallet provider, a routing partner, a data provider or the Solana network itself.

Where liability cannot lawfully be excluded, Kommunity's aggregate liability to you is limited to the total platform fees Kommunity retained from your trades in the three months before the event giving rise to the claim.

Nothing in these terms excludes liability for fraud, for wilful misconduct, for gross negligence, or for death or personal injury caused by negligence.

11. Indemnity

You will indemnify Kommunity and its officers, employees and contractors against any claim, loss or expense arising out of your use of the service, your breach of these terms, your breach of any law, or your infringement of anyone's rights.

12. Changes, suspension and termination

We may change these terms. A material change raises the version and requires your acceptance before you can trade again; other changes are published here with a new date. Continuing to use Kommunity after a change means you accept it.

You may stop using Kommunity at any time and close your account from your privacy settings. Closing your account erases what identifies you; records of trades, fees and payouts are kept as accounting records, linked only to an anonymous identifier. We may suspend or end your access as described in section 6.

13. Governing law and disputes

These terms are governed by the substantive law of Switzerland, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

The courts of Switzerland at Kommunity's registered seat have exclusive jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of the mandatory rules of your country of residence, and you may also bring proceedings in the courts of that country.

Before starting proceedings, please write to us. Most disputes are a misunderstanding about a transaction and are settled in a day from the on-chain record.

14. Miscellaneous

If a provision of these terms is held invalid, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement; we may assign it to a successor in connection with a reorganisation or a sale of the business. These terms, together with the Risk disclosure, the Affiliate terms and the Privacy policy, are the whole agreement between us.
